What is Meant by Abetment

1- INTRODUCTION

Abetment is to provoke, urge, instigate or encourage Someone to commit an offence. The offence of abetment is Subs
tantive offence means complete meant offence and does not depend upon other crime for it's element. Therefore the fact that the principle ( abetted person ) cannot be brought to trial does not charge of abetment against abettor. Even acquittal of Principle is no bar to conviction of abettor. 2-

3- Meaning of Abetment.

According to Black's law dictionary,

To encourage and assist someone in Commission crime or by active to Support a crime by active assistance 


4- Interpretation of Term " Abetment" U/S 107.

A person abets the or doing of a thing who,
           Firstly, Instigate any person to do that thing
           Secondly, Engage with one or more person in doing any conspiracy for the doing of that thing it an oct or illegal omission takes place in pursuance of that conspiracy and in order to doing of that thing.
           Thirdly, Intentionally aids by an act or illegal omission, the doing of that thing.

5. Modes of Abetment mentioned in section 107

                          Instigation
                          Conspiracy
                          Aid 

I- Abetment by instigation.

 A person abets the doing of a thing who instigates, any the person to do that thing.
Explanation
 A person who by willful misrepresentation or by willful concealment of a material fact which he is bound to disclose
Voluntary causes or procure or attempt to cause or procure a thing to be done is said to instigate the doing of that thing.

II- Abetment by conspiracy

A person abets doing of a thing, who engage with one or more person in any conspiracy for dosing of that thing it an act or illegal omission take place

 III- Abetment by Aid

A person abets the doing of a thing 
Who maybe an Abettor
A person abets an offence who abets either
Commission of an offence
Or
Commission of an act which would be an an offence if committed by a person capable by an offence with Same intention or of committing knowledge as that of abettor.

5- Principles Relating to offence of abetment 

I- Abettor himself may not bound to the same act

The abetment of illegal mission of an act may amount to an offence although abettor may not bound to do that act 

II- Commission of act abetted is not necessary

To Constitute the offence of abetment. it is not necessary that act abetted should be Committed or that the effect requisite to constitute the offence should be caused.

III- Person Abetted maybe not capable of committing offence

It is not necessary that person abetted · should be capable by law of committing offence or that to should have same guilty intention or Knowledge as that of abettor

 IV- Abetment of Abetment.

The abetment of an offence being an offence the abetment such an abetment is also an offence. 

V- Concert with person Abetted Not necessary

It is not necessary to commission of the offence of abetment by Conspiracy that abettor should concert the offence with person who commits it. It is sufficient if he engages in the conspiracy which the offence is committed. in pursuance

VI- Abetment in Pakistan of offence outside u/s 108-A.

A person abets an offence within Pakistan abets the Commission of any oct without and beyond Pakistan which would constitute an offence in committed in Pakistan.

6- Punishment for Abetment 

 I- If Act abetted committed in consequences and where no Express provision provided for punishment 
Same as for offence Committed.

The abetment of an offence in ch# XVI shall be liable to punishment of Tazir specified For Such offence including death. (PLD 1989 SC 633 ) 

II- If person abetted does act with difference intention from that of Abettor u/s 110

The abettor Shall be punish for offence as abetted and not for offence actually committed.

III- One act abetted & different act done.



 The abettor is liable for act done in Same manner and to Same extend as if to had. actually abettedVI- Two Different Acts Done. S.112.
When act abetted is done and also another act which is also a distinct offence is done. the abettor shall be liable for both act

V- Effect Caused By Act Abetted is different which was Intended u/s 113.

The abettor shall be liable for effect Causes

VI- Abettor present when offence committed u/s 114

He Shall be deemed to have commit such act or offence

VII- Abetment of offence punishable with death or imprisonment for life if offence not committed u/s 115

 Imprisonment of 7 year if offence not Committed AND
 Imprisonment of 14 year if hurt is caused

VIII- Abetment of offence punishable with imprisonment. if offence not committed

1/4th (longest imprisonment or  fine or both.

IX- If abettor or person abetted is a public servant whose duty to prevent offences u/s 116

 1/4th (longest. imp or fine or both

 X- Abetting commission of offence by public or more than 10 persons u/s 116 

Imp (any)- 3 years or fine or both

XI- Concealing design to commit offence punishable with death or imprisonment For life if offence committed u/s 118 

7 year or fine if offence committed


3 year or fine if offence not committed 

XII- Public servant concealing Design to commit offence.

 》if offence committed
1/2 (longest term or fine) if offence punishable 10 year if offence punishable with death or life. It offence not committed 1/4 (longest term )

 XIII- Concealing design to commit offence punishable  with imprisonment u/s 120

 if offence Committed (1/4 longest term
If the offence not committed (1/8 th longest term)
