Modes of Compel Appearance of Any Person By Warrant

1- Introduction 

A process requiring a person to appear in court. He maybe of Accused, Complainant, Or Witness. The person maybe compelled by Summon, Warrant, Or Attachment of Property for his Appearance in the court whenever required.

2- Relevant Law 

Section 75 to 86A of CrPC

3- Warrant 

Any person can be compelled to appear in the court by Warrant whenever the court required. 

4- Compelling by Warrant 

When the person calling to appear in the court could not appeared then Warrant issued by the court for that person's Appearance. 

I- Meaning of Warrant 

Warrant is a specific authorization by a competent authority to Arrest any person due to illegal act.

II- Particulars of Warrant 

        Following are the Particulars of Warrant,

                   A Warrant should be,

                                   》In writing 

                                   》Signed by presiding officer

                                   》Sealed bear of the court

III- Continuance of Warrant

Warrant shall be remain in force until it is cancelled by the court Or until it is Executed. 

IV- Warrant to be Directed 

                Warrant is directed to, 

                                   》One or more police officer 

                                   》Any person where no police officer present. 

V- Warrant Directed to Landlord 

Warrant also directed to landlord, former, manager of Land. 

VI- Police officer empowered by Endorsement 

A Warrant directed to any police officer may also be executed by any other police officer whose name is endorse upon Warrant

VII- Notification of Substance of Warrant 

The person executing Warrant shall notify the Substance or show of Warrant to person to be arrested.

VIII- Kinds of Warrant

                  Warrant maybe of

                                     》Bailable 

                                     》Non-bailable

IX- Warrant Executed 

Warrant of arrest maybe executed at any place of Pakistan 

X- Warrant outside Jurisdiction 

A Warrant maybe forward to the court in whose local Jurisdiction the person so arrested reside.
