Modes to Compel  Appearance of Any Person By Summons

1- Introduction 

A process requiring a person to appear in court. He maybe of Accused, Complainant, Or Witness. The person maybe compelled by Summon, Warrant, Or Attachment of Property for his Appearance in the court whenever required. 

2- Relevant Law 

Section 68 to 74 of CrPC

3- Summons

Any person can be compel to appear in the court by Summons whenever the court required,

I- Meaning of Summons

A person requiring by this process to appear in court. He maybe Accused, Witness, Or Complainant.

II- Particulars of Summons 

A Summons should be

                                   》In writing 

                                   》In duplicate 

                                   》Signed and sealed by court or officer

                                   》Form of Summons

                                                    Schedule V and Section 555 of CrPC

III- Contents of Summons 

                Following are the contents of Summons

                                  》Title of the court

                                  》Place of sitting

                                  》Date of Appearance 

                                  》Timing of the court

                                  》Description of the court

IV- Summons by Whom Served

                 Summons will be served by Following persons

                                  》Police Officer

                                  》Officer if the court on behalf of the government 

                                  》Other public servant 

                                  》Complainant or Accused to his Own Witness 

V- Modes of Service of Summons 

         Following are the modes of service of Summons 

                     (A)- Personal Service 

                         Summon can be served personally 

                                 》By delivering and tendering one of duplicate 

                                 》Sign a receipt on book of duplicate 

                      (B)- Substitute Service 

                          Summons can also be served substitutly, 

                                 》By exercising of due diligence 

                                 》Duplicate on some adult male member

                      (C)- Affixation 

                          Summons can be saved by Affixing, 

                                 》Conspicuous part of house, homestead 

                                 》Effect dully served

VI- Service upon company

       A summon served  upon company By,

                                》Secretary, local manager other principle officer

                                》Registered part letter address to chief officer

VII- Service upon servant of state or of railway

      Summons to railway maybe send in duplicate to head of office.

VIII- Service of Summons outside local limits

Send to Magistrate within local limits of whose Jurisdiction, the person summoned reside.

IX- Proof of service of Summons 

       Summon can be proved by

                                  》Affidavit 

                                  》Duplicate of Summon endorsed by person.
