Rules of Conducting Identification Parade

1- Introduction

Object of Identification Parade is to enable witness to Identify these persons or things, which are involved in commission of offence and which are not previously authority on involvement of such person or things in commission of offence. Identification Parade is related to these facts which are declared as relevant facts about place, name, person or date. The conduct of Identification Parade is part of investigation and is held not as a rule of law but as a rule of prudence to eliminate possibility of mistake.

3- Meaning

Meaning of Identification Parade is Identification of stranger offender, who is not previously known to the witness.

4- When Identification Parade should be Conducted

Identification Parade should be conducted at the earliest possible time because the Witness to Identify the accused easily, as by the laps of time, memory may fade. Identification Parade held after 12 to 15 days losses its evidentiary value.

5- Who Conduct Identification Parade

Identification Parade is conducted by a Magistrate having Jurisdiction to do so.

6- Scope of Identification Parade

Identification Parade is relevant to both civil and Criminal cases.

8- Purpose of Holding Identification Parade

Identification Parade is always held for two purpose,

》To establish identity of culprit

》To pin-point role played by culprit

9- Witness right Perception to See an Object

Circumstances on which person right perception of an object seen by him Depends,

》On his situation relative to the Object viewed his nearness to or distance from it.

》Also on his capacity to see with perfect 9r sufficient distintness and Object far-off

》He maybe able to discern clearly things at a great distance from him or to see distinctly only Object near to him that is, he maybe either far-sighted or near-sighted.

》On the light by which it is seen and therefore, on the time whether day or light.

》On the length or shortness of time he has in which to view the Object.

》The sunshine on face of a person and same effect maybe produce by falling snow.

10- Rules Holding Identification Parade = PLD 2018 SC 488

Following are the rules,

I- Time

Identification Parade should be conducted at the earliest possible time.

II- Supervision

It always supervised by a Magistrate having Jurisdiction to do so.

III- Place

It conduct generally, in jail or some other secured place.

IV- Investigation Officer

After beginning of Identification Parade investigation officer or any police officer, should not have access to Witness.

V- Complaint Witness

If the complainant himself a witness only then he can participate in Parade.

VI- Separation of Witness from each other

For holding Identification Parade, it is necessary that Witness should be kept separated from each other so that cannot share any information about accused.

VII- Bringing Witness for Identification Parade

It is necessary that Witness should be brought separately for Identification Parade.

VIII- Dummies

For one accused there should be serial of 1-9 Dummies

11- Evidentiary Value of Identification Parade

I- Corroborative Value

When witness deposes during Identification Parade that he has seen some of persons, who are present in Identification Parade, on time, date, and place of incident, it 8s consider that such deposition has Corroborative Value.

II- Admissible Evidence

Another view As that Identification Parade can be substantive piece of evidence especially when proper procedure is adopted for Holding of Identification and all legal requirements are fulfilled.
